Terms & Conditions

These Terms govern every visit, membership, document upload, assessment request, police report draft and other output generated through AssessClaim.Com.

1. Agreement and operator

AssessClaim.Com (the “Platform”) is operated by Allix Holdings Sdn. Bhd. (“Allix”, “we”, “us” or “our”). By accessing the Platform, creating an account, selecting an acceptance box, uploading any record, requesting an assessment or using a report, you enter into a binding electronic agreement with Allix and accept these Terms.

If you do not accept every provision, do not use the Platform. Electronic acceptance and conduct may evidence agreement to the extent recognised by applicable law.

2. Eligibility and authority

You must be at least 18 years old, have legal capacity and provide accurate registration information. If you act for a claimant, employer, firm or other organisation, you warrant that you are authorised to bind that person or organisation and to give all instructions, permissions and warranties in these Terms.

3. Nature and scope of the service

The Platform organises uploaded material and uses automated systems to produce a preliminary assessment of matters such as chronology, liability, contributory negligence, injury-related damages, documented financial losses, evidence gaps and case quality. Any projected amount is an indicative range based only on the material processed and assumptions stated in the report.

The Platform may also organise user-entered incident details and uploaded material into an editable bilingual police report draft. That draft is a preparation aid only: it is not submitted to PDRM, does not create an official police report and must not be described as approved, verified or endorsed by PDRM.

The service does not investigate witnesses, inspect an accident scene, authenticate records, conduct a medical examination, obtain undisclosed evidence or replace pleadings, expert evidence, insurer evaluation, negotiation or judicial determination.

4. No legal, medical or other professional advice

Nothing on the Platform or in a report is legal advice, a legal opinion, medical advice, a medical diagnosis, an expert report, financial advice, insurance advice or a promise of recovery. No solicitor-client, doctor-patient, fiduciary, insurer-insured, agency or other professional relationship is created between you and Allix.

You must obtain advice from appropriately qualified professionals before making a claim, accepting an offer, commencing or discontinuing proceedings, incurring expense or making any decision affecting rights, health or finances.

5. AI output limitations

Automated output is probabilistic and can omit, misread, misclassify or invent information. A Matter Score measures the apparent quality of the material supplied; it is not a probability of winning, a credit score or a guarantee of settlement. Liability percentages and quantum figures are not admissions, offers, valuations by an insurer, or predictions binding on any person.

A police report draft may incorrectly describe a person, vehicle, time, location, sequence, injury or source. It does not establish fault, an offence, criminal responsibility, civil liability or the truth of an allegation. Questions, conflict flags and source references are aids to review, not verification.

Law, guidance, prices, medical evidence and the factual record may change. We do not promise that a report is complete, current, admissible, suitable for a particular purpose or free from error, and we have no continuing duty to update a report after it is generated.

6. Your verification and deadline duties

You are solely responsible for checking every extracted fact, calculation, citation, assumption and conclusion against the original records and current law. You must preserve the originals, obtain independent professional review and correct errors before using or sharing a report.

Before using a police report draft, you must compare every sentence with your own recollection and the original material, remove anything inaccurate or misleading, identify genuine uncertainty and ensure that the account reflects what you honestly know. You are responsible for making any report through the appropriate official PDRM channel and for the truth and completeness of the information you provide.

The Platform does not calculate, monitor or extend any limitation period, appeal period, court date, notice requirement or other deadline. Urgent legal or medical matters must be taken directly to a qualified professional or the appropriate emergency service.

7. Accounts and security

You must keep your login credentials confidential, use a secure device and promptly notify us of suspected unauthorised use. You are responsible for activity under your account unless caused by our breach of a non-excludable legal duty. Accounts may not be sold, shared, transferred or used to conceal another person’s identity.

8. Uploaded documents and your warranties

For every upload, you warrant that the record is genuine to the best of your knowledge, lawfully obtained, relevant, free from malicious code and not altered to mislead. You further warrant that you are the data subject or have all authority, consent and lawful basis required to disclose and instruct the processing of personal data, health information, identity records and third-party information contained in it.

You must not upload material in breach of confidentiality, privilege, court order, statutory restriction, intellectual-property rights or another person’s privacy. Uploading material does not itself create legal professional privilege, and we do not guarantee that privilege or confidentiality will be preserved against third parties.

9. Limited processing licence

You retain ownership of your documents. You grant Allix and its authorised infrastructure, security and AI service providers a limited, non-exclusive licence to receive, copy, convert, scan, extract, analyse, transmit and temporarily hold the material only as reasonably necessary to provide, secure and troubleshoot the requested service, comply with law and enforce these Terms.

10. Personal data and security

Personal data is processed for assessment delivery, account administration, security, legal compliance and support in accordance with the notices and permissions presented on the Platform and applicable Malaysian data-protection law. Processing may involve authorised service providers and cross-border infrastructure where lawful safeguards and required permissions apply.

The assessment and police-draft workflows are designed not to save uploaded evidence in AssessClaim.Com’s own case database as part of the current process, although temporary processing copies and operational records may exist for the period reasonably required to complete, secure or retrieve the service. No internet service is absolutely secure; you accept the inherent risks of electronic transmission and must keep your own complete copies.

11. Permitted report use

Subject to these Terms, you may download and use a report for the matter to which it relates and share it with your professional advisers, insurer or other properly authorised recipient. You must not describe the report as an independent expert opinion, certified valuation, legal advice, medical opinion or guaranteed outcome.

You may edit and use a police report draft solely as a personal preparation aid for the related incident. You must not describe it as an official report, police finding, verified statement or PDRM-approved document, and you must not submit text you know or suspect to be false or misleading.

12. Intellectual property

The Platform, branding, interfaces, assessment structure, prompts, software, design, original content and compilation are owned by or licensed to Allix and protected by applicable law. Except for the limited report use above, no right is granted to copy, resell, publish, scrape, train another system on, reverse engineer, remove branding from or create derivative commercial services from the Platform.

13. Prohibited conduct

You must not use the Platform to fabricate or manipulate evidence; deceive a court, insurer or other person; impersonate anyone; infringe rights; upload unlawful or harmful material; probe security; bypass access controls; introduce malware; overload the service; automate extraction; reproduce the system for a competing service; or assist another person to do so.

14. Independent lawyers and third parties

Any lawyer, medical practitioner, expert, insurer, payment provider or other third party is independent from Allix unless expressly stated otherwise. An introduction to a panel lawyer is not legal representation, endorsement, agency or a guarantee that the lawyer will accept the matter. Any professional engagement is governed by a separate retainer directly with that provider.

Third-party sites, services and source material are subject to their own terms. To the extent permitted by law, Allix is not responsible for their availability, advice, acts, omissions or content.

15. Fees, cancellation and refunds

If a fee applies, the price and payment terms displayed at checkout form part of these Terms. You authorise the stated charge. Because digital analysis may begin immediately after submission, cancellation may not be possible once processing starts. Refunds, repeat performance and other remedies remain subject to any mandatory consumer rights and any specific written offer shown at purchase.

16. Availability, changes and suspension

We may maintain, modify, restrict, suspend or discontinue any part of the Platform, and may set technical or usage limits. We may suspend or terminate access where reasonably necessary for security, legal compliance, non-payment, investigation or suspected breach. We do not guarantee uninterrupted availability, recovery of staged files or permanent storage of reports.

17. Disclaimers

To the fullest extent permitted by law, the Platform and every output are supplied “as is” and “as available.” Allix disclaims implied representations, conditions and warranties concerning accuracy, completeness, merchantability, fitness for purpose, non-infringement, availability, security and results. No disclaimer limits a statutory guarantee or right that cannot lawfully be excluded or restricted.

18. Limitation of liability

To the fullest extent permitted by law, Allix and its directors, officers, employees, contractors and licensors are not liable for indirect, incidental, special, exemplary, punitive or consequential loss; loss of profit, opportunity, goodwill, anticipated recovery or data; missed deadlines; evidential prejudice; or decisions made in reliance on an output without independent professional verification.

Where liability cannot be excluded, Allix’s aggregate liability arising from the Platform or a related assessment is limited to the greater of RM100 or the fees you actually paid to Allix for the service giving rise to the claim during the preceding 12 months. This cap does not apply to fraud by Allix or any liability that applicable law prohibits us from limiting. You must take reasonable steps to avoid and mitigate loss.

19. Your indemnity

To the extent permitted by law, you indemnify Allix and its personnel against third-party claims, regulatory action, loss and reasonable legal costs arising from your unlawful or unauthorised upload, infringement of rights, fraud, material breach of these Terms or misuse of a report. This indemnity does not apply to the extent a loss was caused by Allix’s own negligence, fraud or wilful misconduct.

20. Events beyond reasonable control

Allix is not responsible for delay or failure caused by events reasonably beyond its control, including telecommunications or cloud failures, cyberattacks, power interruption, natural disaster, epidemic, industrial action, government action or failure of a critical third-party service, provided this clause does not exclude a duty that cannot lawfully be excluded.

21. Changes to these Terms

We may amend these Terms to reflect service, risk, security or legal changes. The updated version will state its effective date. Material changes apply prospectively and, where required by law, will be notified or presented for renewed acceptance. Continued use after the effective date constitutes acceptance except where express consent is legally required.

22. Governing law and disputes

These Terms and all non-contractual matters connected with them are governed by Malaysian law. Before starting proceedings, you and Allix should give written notice of the dispute and allow 30 days for good-faith resolution. Subject to mandatory consumer rights, the courts of Kuala Lumpur have exclusive jurisdiction. Nothing prevents an eligible consumer from using the Tribunal for Consumer Claims Malaysia or another forum that cannot lawfully be excluded.

23. General provisions

These Terms, together with workflow-specific consent and accuracy wording and any specific written purchase terms, form the entire agreement concerning the Platform. If a provision is unlawful or unenforceable, it will be limited or severed to the minimum necessary and the remainder continues. Delay in enforcement is not a waiver. You may not assign your rights without our consent; Allix may assign these Terms as part of a restructuring, financing or transfer of the Platform, subject to applicable law.
